Ologbo Celebrated Court Case
Adjourns to 26th May, 2021 For Lack of Appearance of First Accused

Speaking to all and sundry
the presiding judge His lordship Justice Itusell stated that the case has been
adjourned to 26th May, 2021 for further hearing. Speaking with press
after the seating counsel to the family of Late Etchie Bar. Matthew Edaghese
stated that the case has been slated for further hearing today, but, the
correctional centre did not produce one of the defendants and that the trial
can’t continue in the absence of one of the defendants that is the provision of
the law as they must all be completed in the court, because they are all facing
the same trial together.
Bar. Edaghese concurs that
the interval the learned SAN the Defense counsel made an application before the
court that he had a motion to seek the leave of the court to appeal adding that
the state counsel rightly asked what are they appealing for because there is no
ruling delivered yet in the trial that is still on going.
The state counsel insisted
that whatever he filed was a motion on notice and that by virtue of the status
of that application the state is entitled to the time stated by law within
which to react and they which to exercise the right. So in the mean time the
court has adjourned till tomorrow 30th April, 2021 for the state to
react to the application file at the defense counsel the learned counsel SAN on
behalf of the defendants seeking leave to appeal against what they do not know
yet by tomorrow they will know what the motion notice is all about.
Reacting to the drama that
took place in the court by the defense counsel saying that he got multiples
pagings from the first accused person that he was feeling alright and again he
was abandoned at the correctional center. Bar. Edaghese stated that
administratively that it is very very very worrisome development for the law as
the correctional center are very much aware of todays date and it is their duty
under the constitution to bring in inmates to and fro to the court for trial on
hearing date. Speaking again with journalist Bar. Edaghese stated that if for
any reason for their own negligence or inefficiency and they allow the matter
to drag on because they woefully failed to do what they ought to have done, it
is really really really unfortunate and saddened adding that that would not
help the smooth running of justice in the land.
